1. Scope of Application
These Terms and Conditions apply to all orders placed through the online store of CVN Clothing ("we", "us", "our").
Our online store offers clothing and, where applicable, accessories and caps. Our products are sold to consumers and businesses within Germany and other countries of the European Union.
By placing an order, the customer agrees to these Terms and Conditions.
2. Contract Formation
The presentation of products in our online store does not constitute a legally binding offer to conclude a purchase contract.
By clicking the order button, the customer submits a binding offer to purchase the selected products.
The purchase contract is concluded when we accept the customer's order by sending an order confirmation by email or otherwise confirm acceptance of the order.
We reserve the right to refuse or cancel an order, particularly where products are unavailable or there are technical or pricing errors.
3. Prices and Payment
All prices displayed in our online store are stated in euros and include the applicable statutory value-added tax, unless otherwise indicated.
Shipping costs, if applicable, are displayed separately during the ordering process.

We reserve the right to offer or remove individual payment methods at any time.
The purchase price is due immediately upon conclusion of the contract unless a different payment period has been agreed.
4. Products and Print-on-Demand Fulfillment
Our products may be manufactured and fulfilled through third-party print-on-demand service providers.
This means that products may only be produced after an order has been placed.
Production and delivery are carried out by our fulfillment partners on our behalf.
Minor deviations in color, size, placement, or appearance may occur due to manufacturing processes, screen settings, materials, or other technical factors. Such minor deviations do not constitute a defect unless they materially affect the agreed quality of the product.
5. Delivery
Delivery times are stated on the respective product page or during the checkout process.
Delivery times may consist of both a production period and a shipping period.
If delivery is delayed due to circumstances beyond our reasonable control, including delays caused by fulfillment partners, shipping providers, customs authorities, force majeure, or other unforeseen events, we shall not be liable for such delays to the extent permitted by applicable law.
If an ordered product is unavailable, we will inform the customer as soon as reasonably possible and refund any payments already made for the unavailable product.
6. Retention of Title
The goods remain our property until full payment of the purchase price has been received.
7. Right of Withdrawal
Consumers generally have a statutory right of withdrawal in accordance with applicable European Union and German consumer protection laws.
Detailed information regarding the right of withdrawal, including the withdrawal period and the procedure for exercising the right, is provided separately in our Withdrawal Policy.
The statutory right of withdrawal may not apply to goods that are manufactured according to the customer's specifications or are clearly personalized, where the applicable legal requirements for exclusion are met.
Statutory consumer rights remain unaffected.
8. Returns and Refunds
Returns and refunds are handled in accordance with applicable statutory consumer protection laws and our applicable return and withdrawal policies.
Where a return is legally required, the customer must follow the return instructions provided by us.
Unless otherwise required by law, products that have been damaged, altered, washed, worn, or otherwise improperly handled by the customer may not be eligible for a refund.
Nothing in these Terms and Conditions limits the customer's statutory rights in relation to defective products.
9. Defective Products and Statutory Warranty Rights
The customer is entitled to the statutory warranty rights applicable under German and European Union law.

Depending on the circumstances and applicable law, the customer may be entitled to repair, replacement, price reduction, withdrawal from the contract, or other statutory remedies.
10. Liability
We are liable without limitation for damages arising from intentional or grossly negligent conduct, as well as for damages resulting from injury to life, body, or health caused by a negligent breach of duty on our part.
For slightly negligent breaches of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract.
The above limitations do not apply where liability cannot legally be excluded or limited under applicable law, including mandatory consumer protection provisions and product liability laws.
11. Intellectual Property
All designs, logos, graphics, photographs, texts, trademarks, and other content displayed in our online store are protected by applicable intellectual property laws unless otherwise indicated.
The content may not be copied, reproduced, distributed, modified, or used commercially without our prior written permission.
12. Customer Obligations
Customers are responsible for providing accurate and complete information when placing an order.
This includes, in particular, the correct name, billing information, delivery address, email address, and payment information.
We are not responsible for delivery problems caused by incorrect or incomplete information provided by the customer.
13. Data Protection
Personal data is processed in accordance with our Privacy Policy.
Our Privacy Policy provides information about how personal data is collected, processed, stored, and used.
14. Alternative Dispute Resolution
The European Commission previously provided an online dispute resolution (ODR) platform for consumers. The EU ODR platform was discontinued effective July 20, 2025.
Consumers may still have access to other applicable dispute resolution mechanisms under national law.
We are not obligated and, unless legally required, do not undertake to participate in dispute resolution proceedings before a consumer arbitration board.
15. Applicable Law
German law shall apply, subject to mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
If the customer is a consumer, the choice of German law does not deprive the customer of the protection afforded by mandatory provisions of the law applicable in their country of habitual residence.
16. Place of Jurisdiction
For consumers, the statutory rules regarding jurisdiction shall apply.
For customers who are merchants, legal entities under public law, or special funds under public law, the place of jurisdiction shall be our registered place of business, unless mandatory law provides otherwise.
17. Severability
If any provision of these Terms and Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The invalid or unenforceable provision shall be replaced by the applicable statutory provision.
